Rules and Regulations
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN IN THIS PROMOTION. The rue21 “Win Your Wishlist” promotion (“Promotion”) begins at 12:00:01 AM ET on November 12, 2009 and ends on 11:59:59 p.m. ET on December 24, 2009.
1. Who Can Enter: The Promotion is open to legal residents of the United States and Washington D.C. who are the age of majority in their state of residence at the time of entry. Minors must obtain the consent of a parent or legal guardian to enter the contest. Associates of rue21 and those living in the same household are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Rules and Regulations and to rue21’s decisions, which are final and binding in all matters. Winning a prize is contingent on fulfilling all requirements set forth herein. We reserve the right to verify the eligibility of winners.
2. How to Enter: There are two ways to enter the Promotion: (1) Visit rue21.com from November 12, 2009 to December 24, 2009 and become a member or enter your e-mail address to log in, go to the “Win Your Wishlist” Promotion, and click “I Accept” to enter, or (2) send a fax to rue21, (724-776-4111) with your name and phone number and a request to be entered in the “Win Your Wishlist” Promotion. There is a limit of one entry per person for the duration of the contest. Once you have entered, you are automatically eligible for all weekly drawings. Any attempt by any participant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void that participant's entries, and that participant may be disqualified at rue21’s discretion. Please be advised that rue may use entrants’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by rue21, such as to notify them of a product or promotion that rue21 thinks may be of interest. Please review our Privacy Policy regarding our use of personal information and commitment to your privacy.
3. Prizes and Prize Drawings: A total of five (5) winners will receive a Two Hundred Dollar ($200) gift card for use by entrants to purchase their rue21 wish list merchandise. One winner will be selected at random every Friday after 4:59:59 p.m. ET from on all entries submitted the previous week. The odds of winning each prize are based on the number of eligible entries received by rue for the prizes, and do not increase if you enter by the internet or by fax.
Prizes are not transferable and no substitutions are allowed except in rue21’s sole discretion. Limit: one (1) prize per person. The gift certificates may not be redeemed for cash. The images of merchandise displayed in the promotion are not necessarily photographs of the actual prizes that will be awarded. Winners are solely responsible for the reporting and payment of all applicable federal, state and local taxes (including but not limited to income and sales taxes) attributable to prizes.
4. Winner Notification. An entrant is not a winner of any prize unless and until entrant’s eligibility has been verified. Potential winners will be notified by email or by phone. Return of any prize or prize notification as undeliverable may result in disqualification and selection of an alternate winner. Winners will be required to respond to the communication from rue21 to acknowledge receipt of the prize. If no response is obtained within 10 calendar days of notification, attempts may be made to reach the winner by phone or mail or, at rue21’s option, the prize will be awarded to a replacement winner drawn at random. In the event a question regarding a winner’s identity arises, entries will be deemed made by the holder of the e-mail account associated with the entry. The winner of a prize must submit an Affidavit of Eligibility and Release of Liability upon request of rue21.
5. Conditions and Limits of Liability: This Promotion is governed by the laws of the United States and is void outside the United States and in any state where the promotion is prohibited by law. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of rue21 which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Promotion, rue21 may, in its sole discretion, void any suspect entries and: (a) cancel or terminate the Promotion (or any portion thereof); (b) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Rules and Regulations; and/or (c) award all prizes claimed prior to cancellation from among the eligible, non-suspect online entries received, up to the time of impairment.
BY PARTICIPATING IN THIS PROMOTION, ENTRANTS AGREE THAT RUE21 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST LIABILITY FOR ANY INJURIES, LOSSES, OR DAMAGES RESULTING FROM PARTICIPATION OR INABILITY TO PARTICIPATE IN THE PROMOTION, ACCEPTANCE, POSSESSION, MISUSE, OR USE OF A PRIZE, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO TRAVEL CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM.
6.
